Trade and industrial secrets or other types of undisclosed information which have commercial value must be protected against breach of confidence. This right is especially relevant for example, where clients decide to keep a process secret rather than to protect it by way of a patent. However not all information is entitled to legal protection. The information must be sufficiently important and must have involved some thought or effort on the part of the person with the idea. Reasonable steps (imposing on its recipient an obligation of confidence) must be taken to protect the confidentiality of the information. Hence it is important for all owners of ideas to be aware of what they consider confidential and the numerous ways in which they can safeguard the information.
